I have a complicated situation and I need advice.
I went away for a few days, and on my return I find that a dry stone wall (which is old and falling down) has fallen by my car causing damage.
No one witnessed a vehicle hitting the wall, but there are tyre marks on the grass verge by the wall. I repeat no one witnessed it being hit.
It is reasonable that it may have fallen in the weather, but it seems that it probably has been hit by another vehicle.
Is the council responsible as the wall was dangerous and falling apart before it was possibly hit? OR is it the responsibility of the person who *may* have hit the wall causing the damage (and since drove off not even leaving a note.)
If it is the councils responsiblity can I sue them no win no fee to get it repaired?
I don't want to involve my car insurance at this stage.
Sensible, informed answers welcome and appreciated.

Look at your insurance policy and you'll probably see you have to report it to them. That said, whomever owns the land where the stone wall is is liable for repairs. They'll have to find anyone who ran into the wall to sue them to get their money back.
