I'm in the middle of a workers compensation claim- everything would have been filed on time until we learned that the employer didn't have workers compensation insurance. From what I know this means that I can go after the employer personally in the form of a personal injury suit. Unfortunately bc the employer doesn't have WC insurance the amount of paperwork I am required to have filed has multiplied. My statute of limitations deadline is right around the corner and there is no way we'll have all the necessary paperwork filed on time. Is there any other avenue to pursue this? Can I still file for personal injury after the statute of limitations is up?

Your question makes no sense. You can't be "in the middle" of your claim if you never filed it. You haven't even started if you haven't filed it.
If you wait too long, you lose your rights. Why did you wait so long?

Check with your lawyer . I think as long as you started proceedings prior to the S.O.L expiring , you`ll be ok .

From what I know (as a paralegal), it might be possible to stop the clock-called tolling-on the matter, or else get some sort of an extension. Ask your lawyer about it.
