Can no-win, no-fee lawyers help with personal injury claims if the driver was uninsured?

Article by Richard Einerhann

If you have been injured in a car accident and the driver who caused the accident was uninsured, you may still be able to recover compensation. The avenue that you will need to take to claim compensation may be a little different. Normally, your insurance company deals with the driver's insurance company to settle the claim, which often means that going to court is avoided. If the driver was uninsured, your options are either to claim against the driver directly, or use the Motor Insurers' Bureau scheme, unless you have comprehensive insurance which covers you.

If you want to claim against the other driver directly, you will either need to negotiate with them to agree a settlement amount or, if negotiations are unsuccessful, take them to court. You should get legal advice from a personal injury solicitor before taking either of these avenues.

If you have been injured in the accident, you must make sure you get appropriate medical attention and keep all of your medical records and expense bills carefully in order - you will need to present these to your personal injury lawyer and, if you go to court, to the court as part of your evidence. Your personal injury lawyer will liaise with medical experts to determine the seriousness of your injuries and get an idea of the amount of compensation you are owed. Compensation can cover not only medical expenses, but also loss of income and the pain and suffering you have experienced.

After looking into your case, your personal injury lawyer may advise you that it will be too difficult or costly to sue the other driver through the civil courts. The main reason for this is typically that the other driver does not have enough money or assets to pay any order that may be made against them, making litigation pointless. They may advise you to use the Motor Insurers' Bureau scheme instead.

If you cannot afford legal advice from a personal injury lawyer, you can contact a no-win, no-fee lawyer. A no win no fee lawyer won't charge you any legal fees unless and until you win your case, and even then the other side is usually ordered to pay them, meaning you get to keep 100% of your compensation payment.
