I am 17, and live in Texas. I'll be 18 in a month or so. I have someone taking me to small claims court for damages they think I am responsible for. My question is, will they be taking me, or my parents to court? Am I responsible for myself at my age now, or will my parents still be held financially responsible? And if he does win the claim against me, what will happen, considering I have no money to my name, or a house. I have a part time job but that pays for car payments, and other things.

My parents know well about the situation. I did file income tax, have a car under my own name, will not live at home in a month due to college, and my parents are not paying for my college considering I got a full ride. And will be 18 in July. My insurance is paid for bythem, but not on the same policy.
Jimbo, I don't think you understand where I'm coming from. I want to be held responsible and take this to court. I don't want my parents to have to deal with the burden. And what I'm being accused of I am not guilty of. Do not make assumptions. I'm a well off, well educated young adult that wants to be held responsible for his actions.

Have you done ANYTHING that shows you are an emancipated minor?

Did you file your own income tax form in 2009 or were you listed as a dependent on your parents form?

Do you still live at home?

Do you have your own car insurance or are you covered on your parents policy?

The fact that you had to ask this question seems to indicate you are still a kid under the control of your parents therefore your parents are responsible for what you do. You need to tell your parents what is going on so they can deal with it.

Lets get real here folks, what kind of weak kneed punk goes and does damage then sits back hoping his hard working parents are going to stand good for the damage. All this useless punk is thinking about is himself and his car payments. there is no contrition at all from him, so lets for once tell it like it is. The incident happened when you were under the legal age of majority therefore your parents will be the ones getting sued.

Can my parents be sued:
Parents can be sued for the willful misconduct of their children. An auto accident would not normally be willful misconduct. Stealing something from someone would clearly be. So it depends.

Can I be sued:
A minor can be sued for anything an adult can be sued for. However, a minor cannot litigate for himself so the parents would be named as "guardians ad litem for ____, a minor".

That is, until you turn 18 at which point they can just sue you, even if it happened before you turned 18.

Can I be sued AND my parents be sued?
Yes. They can be sued for the willful misconduct, or for any conduct of their own such as negligence in giving you a car that you used to hurt someone; and you can be sued for your part in it, with your parents as guardians ad litem. Or in your own right once you are 18.

In Texas at the age of 17 you could legally move out, and it is the legal age of consent. You are an adult now, like it or not. YOU are responsible for your own doings now. Not mommy and daddy.
