Two years ago a woman hired me to assist her on a job. I still haven't been paid and when I ask her about receiving payment she tells me that because I (allegedly) handed in my receipts in late, I held up the billing process for the entire job and no one has been paid and she won't pay me until she gets paid. Do I have to wait until she gets paid for the job? Can I sue her in small claims court and win?

If it has been two years, than she should have gotten paid already. I think shes feeding you bs because it shouldnt take 2 years for it to clear up... something like that shouldnt take longer than a few weeks.

When I worked for a company that had daily time sheets, a stack of time sheets from employees for a single day got delayed. My sheet was in this stack, so i didn't get paid for that day. But, they corrected the issue, and that day was paid to me on the following pay cycle. This is what should have happened with your pay.. delayed a little, yes.. delayed more than a month, no

She probably has already gotten paid, but is withholding that information from you. Go speak with a lawyer and see what they say. They generally offer free consultations. Take with you any paperwork you have to show your side..

Good Luck

She's pushing you off on the people who owe her, that's HER problem, not yours. Her agreement of payment is between you and her, not you and the people she worked for. Sue her before it's too late or you may never get paid, you still might not get paid after you sue her but it might push her into action.

You better hurry up and file a claim before the statute of limitations runs out.

By the way, also call the labor board.

That excuse might fly for a little while but 2 years?????
Take her to small claims court.
