I AM GOING THROUGH A DIVORCE RIGHT NOW AND MY EX-HUSBAND SAID THAT HIS LAWYER REQUESTED A TRIAL FOR THE DIVORCE WITHOUT HIS CONSENT OR SIGNATURE.

Your husband is full of crap how is he going to do that unelss he went and spoke with attorney? An attorney wont even talk to you unless you give him a retainer which is normally at least $ 500.00

No, no, no. This will not happen. First, a trial is very time consuming. For the lawyer, time is money. If his client doesn't consent to a trial, why should the lawyer want to do something which will cost him time without someone willing to pay the bill? Second, and perhaps more important, if a lawyer goes against the will of his client, he is open to being sued by the client, and sanctioned (fined, punished) by the state. A lawyer can advise a client that a trial would be the best approach, but the lawyer must, absolutely must, abide by the client's wishes.
