the stallion was severely injured while in another studs care,they left him in a field for 5days with a severely swollen leg,he has know got a permanent problem with his knee which stops me from ever being able to ride him and he cant be show again because the swelling on his knee is permanent he now has to be retired at the age of 8years.i have tried to keep things amicable between myself and the other party but i have now been told to take them to court as they are not willing to pay for any damages to the horse

If the stallion is valuable then your best option is to take them to court. Even if he's not, you may want to do so anyway. You're looking at vet bills, medications and any other special care you have to provide because the damage is permanent. Your show horse that was once an asset to your stable is now a liability due to the damage inflicted by the other party. Next time you lease a horse arrange for the lessee to come ot your property so you can always keep an eye on your horse in case of emergencies, unless you absolutely know and trust the other person. Any horse I've ever leased has not left the owner's property except in the case of going to a show.
