Answer by lestermount
You would have to have an uninsured driver clause in your policy to collect from your company.
You can not sue your company for something that is not covered by your policy.

You seem to be asking if your insurance contract includes a clause requiring payment if another driver lacks sufficient coverage. This is known as Uninsured/Underinsured coverage and I do not know if you paid for that coverage or not. Read your policy.
You can always go after the other driver.

You can always file a claim with your insurance company. However, unless your policy includes underinsured motorist coverage or some other provision which would require them to pay, you're not going to be able to successfully sue them.
