You don't say if your father was a pedestrian, a passenger, or driving his own vehicle. If he was driving his vehicle, he should first contact his own insurance company. If he was a passenger in another vehicle, he should contact the insurance company that insures that other vehicle. That insurance company may be able to collect from the transporter. If they are unable to help or if your father was a pedestrian, he may need to get an attorney to sue the transporter. Have you already contacted the transporter? You should be able to get them to pay for medical bills and lost time from work, plus reasonable pain and suffering, without having to hire an attorney, but an attorney would probably get you a bigger settlement. Often the attorney will get 1/3 to 1/2 of that larger settlement. If you have to hire an attorney, it may be years before you see any money and then legal fees and court costs may take much of your award.

You don't say where the accident happened. In many states, a driver will lose his license if there are claims against him that he or his insurance company fails to pay.

Edit: Try to avoid courts and attorneys. In any lawsuit, the attorneys are usually the only ones who win. It sounds like your family needs money right away, so you might want to settle out of court. But the other person who answered gave you good advise about talking to an attorney before you accept any settlement. Just remember, the attorney is in business to make money and he makes nothing if you don't hire him. I have heard of people who wound up worse off with an attorney than they would have been able to get on their own, counting the delay, the mental anguish, and the attorneys fees and related costs. You would be surprised at the "extra" costs you will have, including transportation to court and to depositions, clothes for court, letters to the attorney, costs of defending against any counterclaims the other attorney might dream up, etc. (Once your father hires an attorney, you can bet the other side will suddenly look into your father's driving records, his medical history, any drinking or drug problems..... They will try to say that he was the one responsible, or they may try to say that his job was going to end soon, so not much is owed for lost income, etc. etc.)

So, reading into your question, your dad was driving a motor vehicle and was sober. Your dad's vehicle was struck by another vehicle which happened to be a semi truck commercial carrier. You believe the semi truck driver to be at fault. Your dad was seriously injured.

You need to immediately contact an attorney. Research online for a injury attorney that specializes in suits against commercial carriers. Suing a commercial carrier is much different than suing some guy driving another passenger car. As soon as the the commercial carrier's insurance company finds out about this crash they will send a lawyer to the hospital to trick your dad into signing away his benefits for a small sum of money. Your dad must not sign anything or cash any checks (which limit his future claim) until his attorney has had time to review the case.

I hope your dad makes a full and speedy recovery.

PS a friend of mine was seriously injured in a crash (caused by a kid high on pot). his medical bills are over $ 2 million dollars right now and he hasn't been able to return to full work for three years. He is currently performing work known as light duties - to get by.

Firstly lodge an FIR in nearest Police Station. Show copy of FIR to insurance company. Consult a Lawyer to file case in Motor Accident Tribunal.
You would get compensation. Total compensation would be divided in two parts. First part would be paid by Insurance Company and second part would be paid by Truck owner.
