my dog recently escaped from our garden sum how and ran onto the road and got hit by a car and the dog lost a leg,thing is the driver is trying to make us pay for damages to his car,but how do we know that the dog done this damage and the car wasnt in a previose accident,local solicitors say that we are not liable,but we are getting letters from there insurance company saying we have to pay so much for damage done to the car also baylifs threatning letters to,what sould we do,

Call a lawyer and talk options. You may be in a position to counter sue-- the driver might be liable for your dog's injuries, but it is your fault your dog escaped.

If the dog was not under proper control and the car driver had no way of avoiding the accident, the dog is the cause of the accident and therefore the responsibility of the owner as you failed to keep the dog under proper control. However, your point is taken and the car driver should supply evidence that he hit your dog and that the dog caused the accident, This would be in the form of an independent witness. If the facts are clear, the car owner has no option but to look to you for the damages. However, you may have third party liability cover under either your household domestic policy or your pet insurance, if the dog is insured. You should check these options first. Did the driver report the accident to the police as I think that is a formal requirement? But as said, if the dog was to blame, then a claim against you is correct. So check those insurance policies ... I do hope you have them!
