I have sold my house but the bank of the buyers will not lend them the money as there is no building certificate to be found! The house is 6 1/2 years old and only had a 6yr guarantee instead of the normal 10yr one. Who would be holding the relevant certificate? I have had to obtain gas, fire, electric certificates etc at a cost of about £1200. Our solicitor is on with it but i am now worried that if this certificate cannot be obtained the sale will fall through! Any advice appreciated. We are in the Leeds area.

Building permits are usually on file with the builder and the building department located in your town. This would not be something you owned or had on file unless in England this was something they give you when you purchase a new home. In the US this building certificate is received prior to building the house, then inspectors come thru and sign off on different elements in the home, electrical, plumbing, structural, roofing etc., once passed then they can finish, when complete they get a final inspection if everything is satisfactory then a Certificate of Occupancy is issued to the builder at that time they can sell the home if it wasn't sold prior. I believe a copy of my Certificate of Occupancy was included in the closing documents on the home. You might want to check your sales documents (deed, loan paperwork etc) to see if yours is included, but to be honest this would be on file with the local building department that over sees home building and the original builder should have a copy on file hopefully. I'm sure it'll be found but yes, if you cannot locate it the house sale will fall thru as the buyers will not receive the funding to buy your home.
