I was invovled in car accident with no fault of mine. The other driver accepted 100% fault and her insurance company (State Farm) is paying for my car repairs & rental car. How do I claim diminsihed value on my car due to collision from State Farm (3rd party claim) I have 2005 Nissan Altima with 39k miles on it. Accident happened in Texas. Any suggestions?

You can check with Texas rail road commission, they regulate insurance companies, but I think you wasting your time on this claim.
Once your car is repaired, there should be no loss in value.

Usually you can only claim if its obvious that there were repairs done to the vehicle. i.e msimatch paint, obvious dents, etc.

Otherwise, people looking for diminished value are looking to get more money than what they are owed. But anyhoo, I found this online.

Well, since you live in Texas, you may not be able to recover for the diminished value of your vehicle.

Courts in states including Texas, Maine, South Carolina and Delaware have ruled against the idea of diminished value. However, these rulings may only be limited to first party claims, not a third party claim like yours.

You should probably call your states Insurance Commisioner before you do battle with the insurance company.
