we had a car accident, its hard to dtermine whos fault it is(about 2 months ago) and now i get a letter from the lawyer saying he is going to sue me for body injuries! i know this is false becasue i know that peopl etake advantage of the situation to make some money. how do i prove his claims for body injuries are false? we ere going slow, so only cosmetic damage to the cars and no airbags were deployed and no ambulance came. even the police report said everyone was fine

well if the police report says no one was hurt, and no ambulance came, then i think he doesn't have a case.

Evidently he either has injuries, or is able to get a doctor to document that such injuries exist. Chat with your insurance company.

Well, you're going to have to get his medical records, then get a defense doctor to give him an examination. If he's really not injured, your attorney will make a summary judgment motion to get rid of the case.

Get a lawyer and he can get all the files. Even if at the moment of the accident no injuries were reported, he could have developed neck pain from the accident the next day and gone to the hospital

You can have soft tissue injuries, but those would have become apparent within a few days.

i don't see how he has a chance to sue for that if there were no reports of injuries and he did not go to the hospital, I wouldn't worry too much, he has no proof unless he did go to a doctor and have injuries reported within a reasonable time frame after the accident

he can't sue you for anything if they didn't even deploy a paramedic... it's questionable whether you even need your own lawyer, but I'd get some legal advice just to be safe.

Keep in mind that you can sue anyone for anything. You need to contact your insurance company and check your coverage for this. They may defend the suit. If they don't, contact a local attorney about it. Do not try and represent yourself.
You don't have to prove they didn't get injured. They have to prove they were injured because of the accident, that you were the negligent party, and that there is a nexus or connection between your negligence and the damages. You will have to defeat one or all of the allegations to win. Your attorney will know much more about the details as state laws vary greatly.
