Can someone claim for damage for a car accident where there was no damage?
There is no proof either way.
Their solicitor has submitted to my insurance company for damages 3 months after the accident claiming for damage, even though at the time there was no damage and both parties agreed.
Do they have a case? Where do I stand?
Say for example their car does have damage, not from my accident but say they have backed into something/someone else since? Surely they'd have to have proof at the time of my accident to have a case?

You can claim anything, the question is will they pay it chances are no if there is no proof also you could be charged with insurance fraud.

Unless your a qualified Auto body tech who examined the car how do you know there's no damage? Alot of times the damage is hidden or limited to internal areas. So yes they can claim anything they want...it depends if your insurance adjuster excepts the claim.

what are they claiming for? Damage to car or personal injuries/loss/pain/suffering? [a very different thing, for which you have insurance by registration] they need to supply at least 2 independent quotes, they need to prove the damages are your responsibility and then you can pay the cheaper one. The damages have to be paid for, the repairs don't have to be done. Never admit liability, let the judge apportion blame, because that will also direct & apportion the payout.

They might have evidence (or even evidence that was doctored up). It is easy to take a digital camera, take a photo, but set the date of the photo back to the date of the accident with you.
At the very least, your insurance rates will likely go up for you failing to report an incident. If the claim succeeds, then your rates will go up further.
In cases like that, it is best to get the other party to sign a letter stating there was no damage. About 5 years ago, I rear ended another driver. It was totally my fault. First thing I did was ask her if she was OK. At the scene of the accident I didn't even give a little thought to the cost of the accident. I truly acted concerned for her care. I told her to go to the doctor and I'd pay her copay (she never did go).
I then told her I'd pay for her car repair if she'd not report the accident. My record is clean, but I didn't want my rates to go up with a minor accident. I gave her every possible way to contact me (work, cell, email). Every few weeks I'd send her an email asking for the repair estimate. Finally like 4-5 months later she told me she got the car repaired by a friend, and the cost was $ 400. I was happy to pay that amount. I met her, gave her the check, and had her sign a letter stating that the accident was considered paid in full and she'd never come back after me for more. I emailed her the letter first so it wouldn't be a shock to her. All in all, she was really cool about it.
