I met with a lawyer today for a car accident I was just in. The accident wasn't my fault. I have a neck sprain and he said he would settle with the insurance. However, he told me to go ahead and take the settlement that the insurance company would offer me (which won't be much). Why would he tell me to accept their offer when he's going to settle with them? I thought you did one or the other. I just want somebody to explain the reasoning behind it. My lawyer is also a "no win, no fee" lawyer. I'm confused on what to do.
My insurance adjuster left me a message and said he wanted to talk figures with me tomorrow and that my rental (that I pay for through my insurance) is up on Monday.

I'm sorry, but I have no idea why your attorney would tell you this. Why not call and ask him directly? Perhaps it's just to get the quick settlement so he doesn't have to work. Perhaps it's to get the settlement because there's a problem with the case. Perhaps he sees another route that he can go to sue.
If you do not agree with it, find a new attorney and make it clear that you don't want to settle.

Well, I would not sign anything until I got a doctors opinion about my neck. that is what is important, not the money? right. you might have something that needs fixed. Your lawyer will get his % of your settlement for doing nothing. you could have done this by yourself, he is looking to make a fast buck. or thinks your neck is ok, and you won`t get more money. Think this over and follow your mind as to what to do, that is best for you. Good luck and hope your neck gets much better. BYE

Ditch that attorney. That's terrible advice. If you sign the settlement offered by their insurance company you sign away any right to future claims. Find another attorney.
Whiplash neck injuries are serious. You could suffer from this off and on for decades. You need an attorney that understands these types of injuries.

the "no win, no fee" lawyers are the worst kind, just semiprofessionals who are more eager to make the fast buck, preying on people who can't afford quality representation. if you have any money at all, get a lawyer who gets paid by the hour and then he'll make sure you get the best option.

Get a new lawyer. The insurance company will make you sign something stating that you forfeit all right to future claims when they settle with you.
