why is my money being held by my solicitor?

Long story but..... I have been fighting an insurance company for nearly 2.5 years now, its slowly coming to an end with a couple of 'offers' being rejected by myself, I spoke to my solicitor asking when 'if they agreed today to the sum requested' how long it would be before I got the 'cash'.
The reply was that even if they paid out today that it would still be 3-4 months while they agree the solicitors fee payment. Example, solicitors fee's are £3500, they say no we'll pay you £1200. solicitor said then they will fight that and push to court to get their money. Meanwhile, my money sits in their accounts. Can I push for the interest on those funds?
They will not release the funds to me until THEY (the solicitor) have been paid.
My feelings are that I think that's unfair, to be honest, why do I have to wait while they fight for theirs?

Is this common practice or have I got a fair/legal case to demand the funds & let them fight without me having anything to do with it?? The longer this go's on the more its going to cost me!!

That's nonsense.

The standard order is payment of the damages in 28 days.

The costs are then paid by the losing side to the winning side.

You've not said what kind of claim this is or whether you've actually issued a claim; but normally the damages are unaffected by the legal costs issues.
