I have a friend who hired a mover to move some funiture to my place. For easy moving, the mover want to drive the big long long truck to my back yard near desk' door but I disagree. I was worried the heavy truck will damage the drainages(pipes) under ground but they said won't. So they drove the truck but the truck sank in the lawn and also damaged my driveway. Due to truck stucked, they have to call a towing to lift it up, but the towing chains damage the mover's big long truck wen lifting. Then the mover asked few hundreds for the movers sitting and waitng for the towing time and towing fee. My friend said no. So they said they will sue me and my friend for the truck damage and waiting hours' hourly pay. Are they out of mind? Can they win or I will win for the damage of driveway and lawn? Thanks.

They won't win - the driver is responsible. Tell them you are suing them for damages to property, and for lost time and wages.

If they are licensed movers then they should definitely know that the truck weight would be too heavy to be driven on the yard. They did this on their own, so you are not resposible for any of the damages. They should have to pay for everything to be fixed.

I'd certainly fight it. I would also file a counter suit for the damages they caused at your home based on the fact that you told them NOT to drive to the back yard. Make sure to get written estimates of the cost of repairs in order to do it

While the movers are supposed to be professionals, I kind of react differently than some answers. I think your friend should make a modest offer to settle the issue. Assuming they actually file an action against you. In the modern world, you have so many lawyers that some starving guy will take the case and work with all the enthusiasm of someone in an important case. It is nice to be a friend. But, the reason many of us do not care for the liberals in politics is that they allow any small event to be the subject of a lawsuit. But, back to your case. I really think your friend should step and cover your back if lawsuit is instituted.

moving companies must be bonded(insured) by the stateThey are responsible for the proven damages to your property and, of course the wrecker is inturn (also being bonded) responsible for damages to the moving van if it was negligence on his part that caused the damage to the truck.

The Movers insurance should cover their damages and yours. Ask for their insurance carriers name and phone number.
