I was in an accident with a commercial vehicle and have suffered a back and pelvic injury. I am still recovering and have been told that I will have to live with this injury for quite some time... I am in the last leg of my case against the insurance company and am wondering what is the maximum compensation for a commercial vehicle accident???

I believe about five times your medical bills would be considered a generous settlement if you will eventually fully recover. If you were to need medical treatment for the rest of your life then an estimate would be made of how much money you would need but you can't get more than what there is to get.

There is no hard and fast maximum other than what the companies insurance limits are and what their assets are if you sued for the total worth of the company plus their insurance. You might get a judgment that is higher but you'll probably never collect it.

Hiya:

The maximum compensation is the COVERAGE LIMIT stipulated in the policy providing the coverage.

So, for example - if the commercial policy only has $ 100,000 coverage...that is the maximum you can recover under their policy.

Some commercial policies have excess coverage but excess coverage is only triggered under certain circumstances so - no sure bet there.

If you have UNDER insured motorist coverage (and your claim is worth more than the limits of the primary payer) - you can make a claim through your own coverage as well UP TO the coverage limit.

Also, something you should know - some jurisdictions LIMIT the amount you can recover if you try to take the commercial carrier to trial.

Hope that helps and hope you're better soon.

Good luck.
