My husband was a passenger in an auto accident while enroute to a work appt. and sustained minor injuries. The driver of the car he was in (a co worker) was found at fault by the police. Who can he file a claim against? The driver's insurance? his employer? Also what can he claim? Can you give me a figure or formula? It has been months and he is still in pain and may have lasting injuries. Now they are denying his continued phys. therapy. Please help!

You should get a workers compensation lawyer asap. They usually see you for free and work for free until you settle with the company then they get a fee out of the settlement. Sometimes you can a years salary out of the insurance company if he looses that much time at work but not much else- it really depends on how bad his injuries are.
I would think if he was on the clock - it would be the employers workers comp but it could be the car insurance company if he was only on his way to work.
The lawyer will know.
You could try it with out a lawyer but the laws are very complicated and many people get nothing!

He claims against the company and driver both. The claim is for actual damages and pain and suffering. The lawyer will come up with a number.
