file a claim with your insurance company. Let them handle it. Or get a lawyer that specializes in personal injury accidents. See what your insurance company will do for you first.

The claim does not begin the settlement process until you stop treating and have been released from the dr.

How long you treat has a lot to do with how long it takes.

Once you get done treating, the adjuster will have you sign a medical authorization. This form lets the medical providers who treated you send the insurance companies copies of your medical bills/records. It can easily take 2-8 weeks for the records to be sent to the insurance company. Sometimes longer.

Once the insurance company gets all the medical bills/records, they evaluate the records and make you an offer.

Once you and the insurance company reach an agreement on a settlement amount - then you (and your spouse if married) sign the release that settles the claim and the insurance company sends you the check.

If you hire an attorney - the process can take a little bit longer because there is another person involved. With a lawyer, the insurance company talks to the lawyer .....the lawyer talks to you....the lawyer gets back to the insurance adjuster.
