I was in lease then no lease done put in notice 30 days in middle of month I did move in on middle of month but lease up for 6 months when moved out now they will not give deposit back because I gave in middle of monchecksgave 30 days no lease have checks paid week before due date always no damage at all should I try small claims or just forget it I could see if bad reAlto paid late or damage but not alot of money but if win they have too pay small claim fee and they sent the amount I did get back 35 days after not in 30 days anyone know

That is really garbled.

You take issues like this to small claims court. A lease is not necessary, but it sounds like you had one, the terms of it still apply, even if expired, you were simply month to month after that.

If you paid your rent monthly at the first of the month then it doesn't matter that you gave notice in the "middle" of the month. You need to give 30 days notice, but 30 days before the next payment is due. So if you give notice on December 3 or December 31st, that notice is effective January 1. Giving notice in the middle of the month means you are on the hook for the entire next month in most cases, and it sounds like this is what they deducted from you. If you feel that they did not return the remaining deposit to you in a timely manner according to the laws in your state, and you can prove that (postmark, check date, etc) then go ahead and take them to small claims court.
