On the 3rd of February, I was driving down a two lane road when all of a sudden, a truck came out of a parking lot on the left and hit my car. The crash was so severe that my car was pushed to the on-coming traffic lane. Fortunately, I was fine. But my car suffered some serious damage. After the police were called to the scene, the other driver and I exchanged insurance info and went our ways. I filed a claim as soon as I got home. One with my insurance and one with his. Then I found out that this guy had cancelled his insurance months before this accident and that he'd given me a false insurance policy number. I tried to contact him, but he doesn't answer his phone. My insurance is going to fix my car, but I still want to find this guy to get some kind of compensation for my troubles and for him to pay for a rental until my car is fixed. If and when I find him, could I sue the guy or do I just not have a case against him? Any help would be appreciated. Thanks.
When I called and asked why didn't the police check to see if the guy is insured or not, I was told that you can always buy insurance for a month or two and then cancel it. You'd still have the insurance ID card which will have an expiration date of 6 to 12 months and not the date or the fact that the driver is uninsured.

You should call the police and tell them, what he did is against the law.

Be prepared with your accident report because they will probably ask for the accident report number.

Also, dont call 911, call the non-emergency number for the police.

You can sue him for hitting your car, but giving false insurance information is a criminal matter.

did you kinda forget about the police? He is required to have insurance and you seem to have proof he does not have it so he is in violation

I got hit by a big rig who gave me false insurance information. I used my uninsured motorist coverage on my policy to pay for my damages so I could get my car fixed. My insurance company went after the trucking company and got my $ 500 back.

I was told I could sue the trucking company for bodily injury and the rental car fees but they went out of business shortly after the accident (go figure)

Odds are the guy that hit you doesnt have any money to pay you even if you won a judgement. you should find an attorney that works on contingency, An attorney will know what your case is worth and can find out if the guy has any assets he can attach.
