The person was walking their dog past the property when the attacking dog scaled the fence to attack. The property is fully fenced and secured. Just received a letter from the solicitors of the person who was attacked seeking compensation. From what I can gather the dog that was attacked died and the person was bitten.

Believe it or not, a good friend of mine is going through something exactly like this right now. She is a tenant and their dog bit a child who was visiting. Now the landlord is being sued for damages. But I personally dont think it is going to fly as the tenant is responsible for their own dog and its actions, not the landlord. I figure they are suing the landlord for damages as my friend basically does not own anything and we dont have any type of avenue for enforcement of judgments in my state, whereas the landlord owns property, therefore being able to collect money for damages like liening the property. But again, I really dont think this is going to fly.

Interesting question--if you are sued you have coverage under your homeowners liability portion--but are you liable for your tenants dog? I thought that tenant insurance just covered contents-good luck

It doesn't sound like you should be considered liable, unless they say that you were negligent because the fence should have been higher.

Contact your insurance company. They may defend you in court against this claim.
