The claim is going on my insurance, but he drove straight into me as I was stationary. Can I still try and claim for my injuries?

if they drove into you how is it your fault if you wasnt moving and you can still make a claim for injury

You can try but when dealing with insurance companies they know all the dirty tactics and will fight you to the end. You will defiantly need a good lawyer.

It depends. If you are in a No-Fault state/province, then yes you can. If you are in a tort state/province, since you are being declared at fault for the accident the other party's insurer is not going to pay. Your only option is to go to court and have a judge declare you not at fault.
