Hi I was recently in a car accident where I had entered a small roundabout, driven around it and was just about to exit when I was hit from behind on the back passenger corner of my car, by a car which had failed to stop at the junction to my left which I had just passed. This driver has not even bothered to contact his insurance company and I seem to be fighting with my solicitors to take the case on. What will happen if he fails to admit liability or worse does not inform his insurance company.
hi i reported it to the police at the time and they turned up however as there were no injuries the other party did not have to stay and so dissappeared as soon as he could he did not even ask for my insurance details although he did give me his own and his address

I had a similar situation happen to me and after 30 days and three attempts to get a statement from the person who hit me, my insurance company found the incident in my favor by default since it was a rear-end collision. I was not penalized in any way and they paid my full deduction.

Did you file a police report?? Or get any information from the other party? i.e. insurance company, policy number, contact info, etc. I believe your insurance company should be able to tell you who was at fault. If you give them the other party's insurance info I believe your insurance company will go after them and seek payments for the damages.

**I AM NO legal expert**, but, seems to me, that IF you got his insurance info, and your ins. isn't in a big rush to do anything to start things off, YOU could call HIS ins. and explain what happened, and his policy #.(start a claim) Also, in MOST of the U.S.A., it's against the law to NOT notify the police, so you might want to call the local police, and ask them when the report will be ready(your ins. will likely not do a thing until they get that report).There WAS an officer who came and wrote up an accident report, right ? If so, then you will need to get a copy- if it shows him to be at fault, then his insurance will either pay, or have to go to court to refute the report. Doesn't make any difference except the time it takes to resolve, whether HE reports it or not.If he denies fault, your insurance should be the one handling the legal, IF the accident report shows him to be at fault.
