I was just contacted by the insurance company and they offered to pay for my medical bills (which they have to do anyways) and $ 750 for pain and suffering. Obviously that's an extremely low number and I want to find out what is acceptable to ask for without having to involve an attorney. The accident was about a month ago and i've had chronic headaches ever since. Any advice would be appreciated. Thanks

If you really have headaches- get an attorney right away. Expect it to take 3-5 years to go to court. The ins co had attorneys working right now to keep from paying you- even though they are telling you they will pay so much. They are hoping you will not get a lawyer and also hope you are dumb enough to wait.
You have 2 years time from the date of the accident to file a law suit- after the deadline- they don't have to pay for anything.

When determining how to settle a claim for injuires many things are considered. the damages your vehicle settled for, the amount of your medical bills, the causality between the two, your actual injuries, and where did the accident occur. All this comes to play. For a $ 750 settlement I'm betting your bills and damages were not that much. You have to prove your claim. not the insurance companies. There job is to evaluate the infomation given.
If you feel the amount is low then you need to talk to the adjuster to up the offer.
As an adjuster I can assure you an insurance company is NOT afraid of an attorney. It does not guarantee a more lucrative payout. And an Attorney will take 1/3 of what you could have gotten on your own. As far as the person who was awarded 100k, I would imagine your injury was life altering and extremely serious to have made that amount of money and to do that without and attorney is quite a feat!!! Not sure if I quite believe that or not. However, Just because someone has 100k in medicals, does not mean you are entitled to it.
Good luck. Counter their offer with what you feel is reasonable.
