If a solicitor commits perjury in an affidavit and wins the case on this information, can we appeal on new evidence if we have a taped conversation which proves his affidavit is a total lie with a view to prosecution and setting aside the judgement?

You cannot use a tape recording in a legal setting if you didn't first inform the person whom you were recording beforehand.
