If someone in the uk has been arrested & is implicated by association in a criminal activity carried out by someone else would it be more sensible to have a seperate legal representative than the other person involved? The other person is known to be rather devious & is encouraging the implicated person to use his legal representative, would he do better to find an independant good solicitor of his own to act for him? Would appreciate someone with legal knolwledge on this one.

It would be more sensible for him to find another solicitor. Where two defendants to a case are not conflicted with each other, then they can be represented by the same lawyer because this saves time and energy and the same approach will be taken to defending each of them. If this person is pleading not guilty and is denying any involvement with the criminal activity, then clearly his evidence is likely to be at variance with that of the other person. If, on the other hand, he is not denying involvement and both are pleading guilty or both are pleading not guilty, then there may not be any such conflict between them and the solicitor could put forward his case while still representing the other party. Without knowing anything about the facts, it is impossible to say more than this. It sounds, however, as though this person has no confidence in this particular solicitor, which in itself is a reason for seeking separate representation.
