I've had my car for three weeks so far and allready got into an accident. It wasnt my fault so theyr insurance company has to pay me. my whole front end is totaled. My car was in excelent condition. i only have liability.

Have you actually filed your claim with that person's insurer for damages to your vehicle as yet? If not you should do this immediately. The police should have been involved or at least notified of the accident.

You will need to read the terms and conditions in your policy document. The amount they will pay will depend upon these conditions in the policy. You say you only have liability - your meaning is not quite clear. Do you mean that your policy is only for third party property damage? If this is the case then you will not be paid anything for the damage to your car from your insurer. You are only covered for the damage you may inflict on the other persons cars. Under these circumstances, you will need to sue the other party for damages to you car if you can prove that they were at fault.

Insurance policies are designed to cover costs of repairs. The other persons insurance company can only be liabile to pay for the repairs to your car. If you have an injury that is a separate matter and requires a separate claim. You would need to see a solicitor to institute proceedings.

IF the other driver was a listed driver, you get the actual cash value for your car.

Assuming that BMW was in perfect condition, and had average milage on it (15,000 a year), I'm coming up with MAYBE $ 2500. Generously. That's what your car is worth. That's what's going to total out your car. So, you'll turn your car over to them for scrap, they'll pay you $ 2500.

They will pay the fair market value of the vehicle. They will consider the year/make/mileage/options and condition of the vehicle. If a book is used, it will be the NADA. However, the value in the NADA will be adjusted to reflect the condition of the vehicle. For example, if the tires needed to be replaced- there will be a deduction on the value. If you removed the cd player from the car - there will be a deduction.

Some companies use a market survey program.

Make you tell the insurance company the excellent condition and any special features of the car and anything that you bought for the car, special tires, rims, and anything new that you just bought.

And, if you have photos of the car give that to the adjustor.
