I am doing well trying to do my own Bodily injury claim. I want to know how you figure out how much you should ask for. I have lost wages of abour 3500 as i only work part time. I have been off work for about 8 weeks from lifeguarding. I have been to an orthopedic doctor about 3 times they are the ones treating me. i have gone to physical therapy for 3-4 weeks and have gone to a chriropractor for 6 times. I have lower back muscle strain, two of my disc are swallow and my sacro illiac (spelt totally wrong but will do research on spelling before i submit my claim). I was not to driver I was the passenger. my insurance paid for my medical bills and i did not, am i still allowed to claim them. The way insurance works is, you may only claim insurance that in this case you medical bills and lost wages, now because you where a passenger on another persons vehicle it can be a bit tricky because they have to have had medical on their auto policy to cover you, usually the insurance company will deal directly with your medical providers and ask for invoices from them therefor eliminating you as the middle man, also for wadges if they will cover them you will have to provide w-2's or recent pay stubs for them to determine the correct amount to give you, we are always advice to ask our clients to file a claim first so that you can find out if in fact you are covered

There is no hard and fast rule for bi claims. Some will tell you to multiply the medical bills x 3. Very few claims are worth 3X the meds. So, if you want to - use that as a guide (3x the bills + wages). But that would be on the high end of what you could possibly be paid.

It all depends on the injury you have, the medical treatment, the damage to your car. If you go and get crazy with the chiro treatment in order to drive up your claim-- that's going to cause problems for you.

The value of the claim is also affected by the laws in your state and the venue where the case would be tried (should it go that far).

The easiest way to settle the bi claim - is to let the adjuster evaluate your medical bills/records and lost wages. Ask the adjuster to make an offer first. This will be at the bottom of the range the adjuster set for the claim. This will give you an idea of what ballpark your claim is in. Go off of that to counter offer. The adjuster will have some wiggle room.

If your claim is soft tissue (sprain/strain) -- and that sounds like what you have-- the range will be a few thousand - not tens of thousands.

For example - if the adjuster opens at 10,000. Then the top of their range is probably no higher than 15,000 -- but more likely 13,000. You could counter at 18,000. If the adjuster comes back at 11,500 - you counter 17,000 or 16,800. Your goal is to end up in the top of the adjusters range.

The best way to get the claim settled is to communitcate with the adjuster. How did the injury affect you? Why do you think the claim is worth $ x.xx. It's by talking and working it out that the claim gets resolved.
