Can they sue you if the insurance already paid? Yes they can. If they are not happy with the pain and suffering settlement they can sue you and the insurance company. The insurance will only pay up to the limits and then you are on the hook for the rest.

Not sure exactly what you're asking . . .if you have a PERSONAL INJURY claim, that's defamation of character, discrimination, or other NON BODILY INJURY.

The JUDGE files the judgement. Another party can file an appeal, a suit against you, or a lein against the judgement.

Typically, in a BODILY INJURY suit, if YOU win a judgement against someone, YOUR insurance company (like, health insurance) will file a LEIN against that judgement, so they get their money back first (for what your medical bills cost THEM.)
