I have a daughter who i'm being charged child support for and has never lived with her mother, let alone spoken to in12 yrs. the mother was on medicade during the pregnancy and my daughter was premature so their asking for 80 k in back support for the birth. I went to the courts and showed them proof that my daughter has not lived with her mother since the age of one and that myself and my family have been providing for her for the past 12 yrs. their response was we can't find the mother so someone has to pay for it, but i don't see why they can't find her, they find me all the time. please i need solid advice, cant afford a lawyer to fight from nevada to michigan need cheeper solution. thanks

I honestly don't think an attorney would be able to help you much. Regardless of where your daughter lived, and who she lived with, if the state paid out monies for her medical care they would like to be paid back. Those responsible for that pay back would be her parents, and that would be you.

I don't understand. Is the court asking for $ 80,000 for the birth or is that for child support after the birth? If it is after the birth, you can file a petition to the court, U.S. Constitution, Amendment 1.,Redress of grievance. You should also file a Writ of Mandamus. That is an order for the judge to do the job that is incumbent upon him. First of all, a petition is not a request as many people believe. It is a demand. You, as the petitioner are the Sponsor. You will need two or more witnesses that agree that what you are writing about is true to the best of their understanding and belief. The more witnesses, the better. They will have to print, and sign their names and print their addresses. They are called the Co-sponsors. You will have to send it to that judge by Certified Mail, Return recipt requested,that made the request for the child support. That way, that judge will have to sign for it.

You can get the information on a Writ of Mandamus at any Law library.

I probably should add that this might all be for naught if you are not legally divorced. It does seem strange that you should have to pay $ 1,333 per month for one child.
