I have a sexual harrassment case going on against an employer that has something to do with mail. My lawyer offered them a settlement for around $ 50-$ 90,000 & there final offer was 5,000 but my lawyer fees are $ 3,000 so I will only receive $ 2,000 should I take it or wait to go to court and risk losing and paying them $ 4,000 of there legal fees or I could also win & get at least $ 50,000
What should I do I only have one day to make my decision... Help.

whats your lawyer think..??? make him put his money where his mouth is...if he doesnt know wether you will win or not, then it seems he doesnt either have much faith in your case, or he doesnt have much faith in his own ability, he shouldnt get more than you...he should at most get a third....if hes got you in a situation where you are going to have to pay him if you lose, then i say he isnt very competent or he doesnt believe in your case very much and doesnt want to expend the time and energy to get you a decent settlement...by the way...i think sexual harrasment suits are a waste of time...cant you take care of yourself..??? how did you let yourself get in a position to be harrassed..??? if it truly is a case of unwanted sexual harrasment, then the lawyer should be doing it on a contingency (%) basis....not a flat fee ....

If you and your lawyer feel that you are correct then I would hold it out to court. Most of the time the jury will side with you and offer you a larger settlment than what the employer would want.

You really need to speak to your attorney and ask him what he thinks the outcome will be. Depending on how strong of a case they think you have. Base your decision on that.

Your lawyer knows the 'odds' of winning better than any of us; he has all the information pertinent to the case. Check with him/her. I wouldn't settle myself...but that's me.

Split the five thousand with your lawyer. You will have a hard time in court. I think your lawyer will advise you to take it and will agree. Better idea tell your lawyer to ask for ten, they might want to end this affair. to a lawyer a dime in the bush is better than nothing

Well.. you have to understand that both sides have lawyers. If the other lawyer is better, you may not get much. It also depends on the degree of emotional suffering you had. Can your emotional suffering be compensated with $ 5,000? If you accept it, the other side is getting away lightly. But don't make it sound like it's all about money. Your personal honor is definitely worth more than $ 5,000... I hope. And also note that you will probably not want to work with the same employer, so you will have to find another job. Until you get one, you will not have income. So, the employer being charged needs to compensate you for the loss of income also, as well as the lawyer fees.

baby gril, you can get millions if you are sexually harassed. TAKE THEM TO COURT. I have never heard of a seetlement that small for S.H. I am in the middle of a sexual harassment case myself and I am not settling without a 6 figure income. I've done research and I know what I can get. But my ex-compnay got Billions too. If oyur employer is small and poor....then maybe you cant get that much but 50-90,000 is a reasonable off. Try to get a contingency lawyer for court. So you only pay them if you win.
