How easy is it? Will the old attorney ask me to pay him? We signed the "pay only if we win" contract. He is not doing his work and I am tired of him. I want to switch lawyer. We are at the middle of this car accident claim. I was rear-ended. I live in Massachusetts, USA. Thanks.

If there is any fee or penalty for voiding the contract it should be included. Read it carefully. No one here knows what the exact terms are. You can always have another attorney look at it and tell you.

If you drop his services before the conclusion of the claim he will probably bill for his time because you give him no opportunity for his percentage of the settlement.
Lots of luck if you get into a situation where a lawyer is the plaintiff and you are the defendant. Courts are run by and for lawyers. Defendants with no lawyers have far less chance at a favorable outcome no matter what the facts of the case are. It is how lawyers stay in business. Judges are lawyers, too. They take care of lawyers very well.

I live in Florida, and had no trouble attaining another lawyer when my current lawyer was doing nothing. I did NOT have to pay him, because as you stated you signed the pay if we win clause. If he does not produce any money for you, you owe nothing. Try talking to other ACCIDENT attorneys, and see what they have to say. You do not state if you are suing for injury or property damage. Those rules are tricky, and vary from state to state. Chances are, if your case is solid, you will have someone jump on your case that is more aggressive. Talk to locals who may have had a similar case. They can be very good at referring. I got lucky, was referred to a new lawyer, and after the case had been stagnant for 2+ yrs, she was able to finish it out, win me a little money, and most importantly pay off the surgery, and accrued medical bills from all this.

It's very easy. Find another attorney. Retain that attorney. That attorney will contact the old attorney and ask for you file. The old attorney will have an attorney's lien against the proceeds of any settlement or jury award for the value of the work he performed.
