I have had a traffic accident, as a passenger. my friend was driving a hired car. he lost control and hit it into a tree. i got some whiplash from the hit, and my neck is sore. it was previously sore due to a sports injury but now is more sore and gives headaches.
so what size of compensation payout am i looking at? i mean, i'm not taking time off work, but need physio and need painkillers.
also what are the flaws of no win no fee? if i don't win, don'it i have to pay the opponents costs?
also when they do the medical checks to see the extent of pains, would they be able to attribute the pains only to the accident, because i don't want them minimising the importance of the accident with the excuse that it was from an old injury?
does anyone have a similar experience?

I had an accident and got a very fair settlement directly from the insurance company. I think most accident/injury lawyers are con artists...they aren't really looking out for you, just the bottom line and what dollar amount will go into THEIR pockets if they win.
Also, although I haven't used an attorney for that kind of thing, I have a hard time believing there will be NO financial impact on you if you lose. Somebody will have to pay their filing fees and whatnot. There is probably some scary fine print to go over very carefully if you choose to go that route.

i had the same thing happen to me, but i was driving and i girl, who is my ex boyfrineds psycho new girlfriend, she ran into the back of me when i was driving... and then when i stopped she rammed me again... YEA CAN WE SAY PSYCHO! anyways... my neck was hurt and my back was fucked up for a whileeeeee and my hands got jammed whne she hit me when i was stopped so i had to quit my job as a waitress, b/c my back. so i was outta work for about 2 months, i had to go to a dr. and a chiropractor for almost a year. it sucked but i gotta lawyer ASAP And it was one that was if you dont win, you dont pay... anywho after about a year. he got my car fixed which was only like a grand, just the back bumper needed to be replaced, got my Dr. bills paid for which were around 5 grand and then i got 6 thousand for my pain and suffering. i had to get the lawyer tho cuz her insurance was trying to say i slammed on my brakes and that i promoted it and my lawyer was soooo good tho, he was basically like she shouldve had enuf safe distance, even if my client did slam on her brakes, etc. etc. etc... i think its well worth it, they are lawyers still b/c they win all the time. my friend referred me to him and she got almost 50,000 b/c a cop hit her at a stoplight! good luck, id do it!

To start with a personal injury lawyer won't take your case, unless he knows you're going to win. He will set up a meeting with you and look at the case.
And yes, the other side will pull up all of your Dr's and hospital records to look for previous injuries. They will definately blame your new injury on the old injury. Trying to prove a new injury is going to be tough for you. If you had broken bones etc, it would make your case alot easier.
My son settled his personal injury claim in the summer. He was hit head-on, on the highway. He had a severley broken femur, and some head, and knee injuries. The lawyers on the other side, pulled up his hospital records from over 10 years ago, and wanted to know why he broke his hand when he was 16. It had absolutely nothing to do with the accident, but these are the kinds of things you can look forward too if you go ahead with a suit.
Also a personal injury lawyer will get 25% of your claim, if you settle quickly. 30% if it goes to discovery, and 33% if it goes to court.
