Sorry, you only have 7 years to collect on pain and suffering. Did you think that your former employers insurance company cared about you? Have you heard from those attorneys who kept sending you to doctor after doctor for treatments that made them rich? I didn't think so!

Workmans compensation works like this: you have a specific injury, and there is a chart that shows how much you get for that injury.
For example, if you lose a finger, that may be worth 25 weeks of pay. Let's say you were making $ 500 a week before the accident. You would be paid 25 weeks times $ 500 = $ 12500 and that would be all you get.
Workmans compensation was set up to avoid employers having to deal with a new lawsuit every time someone got hurt.
You typically get the entire amount of you settlement in one lump check, so cashing out the claim makes little sense.
As far as a statute of limitations, the workmans compensation board in each state has set a time table for how long you have to file a claim. It varies from state to state.
