This time last yr I was accused of crashing into someones car. What actually happened was the driver rolled into my car. He is trying to make a claim against me and it has caused me a great deal of stress. To the extent to which I have almost lost my girlfriend through worrying about it... as it made me rather angry at being ripped off so badly!.. my car insurance would increase by over £1000 a year!!

If this goes to court and is ruled in my favour... then the way I see it is he has broken the law in making a fraudulent claim... I have pictures of both vehicles showing no damage. And he is actually claiming for his daughter... i didnt see anyone else in the car and my insurance are in the process of gaining access to check the school records for that day.

My question is.... if it is proved he is lieing... can i put in a claim through my car insurance company to be compensated for the stress caused???????

I'm a big believer in Karma.. that's why I thought about makin a claim... cos right now Karma owes me!! It's been really stressful! I have been in a car crash were everyone in the car claimed apart from me because I genuinley wasn't that injured and didnt feel it necesary to claim.. where as this has really caused mental anguish!

i am not sure exactly, it sounds like this is one of those questions that sounds more logical than it is, it depends on if the stress is bad enough then you may be able to sue for something along the lines of harassment (mentally) or something and get them in trouble for false allegations. Ive heard people of sueing and winning for more off the wall stuff like that so i dont know.

Weirder things have happened. But if you try to do it without a lawyer, you'll be laughed out of court.

Have you got a competent lawyer representing you in the suit against you? If the photos clearly show no damage, they should be able to stop the suit in its tracks.

You wouldn't be able to sue them under your car insurance. That covers only your liability to other people, not their liability to you. The insurance has nothing to do with that.

It would be a matter of a personal lawsuit having nothing to do with cars, but after the fact... a lawyer would be able to advise you how to go about it, if at all possible. It would likely involve something like going and getting a psych evaluation, going to the trauma ward, or going to court on your current case wearing a neck brace.

That is the big wild card in accident cases, of course. Back and spinal injuries. Because it's medially recognized that you can suffer trauma even though they can't detect it through tests, it is very difficult to disprove that you have an injury. If you prove it was the other guy's fault, then you've got them on the hook for an injury. It's an old trick but it's risky too, if they ever prove you made it up. This forum thread would be evidence of that so you probably shouldn't try the fake back injury trick.

Your lawyer might hate me for even mentioning it.

Since you believe in Karma, you might be interested to hear that Karma never affects you during the same lifetime. It's not the same as "what goes around, comes around" or "tit for tat." It's whatever you did in a past life coming back to you in this one, and often in completely different form.

I would really recommend forgive and forget. Better for everyone, better for everyone's karma, and best of all deprives those greedy lawyer types of yet more money spinning litigation.

You can claim anything you like but if you submit a claim you will only be causing yourself more "mental trauma" . If you are in that bad of mental state, spend your money and effort on a good counselor instead of revenge

No, you can't. You can only claim personal injury claims if it is physical injury. You should have got a police report.

Um, no you cannot. You can only claim injuries (and yes I have seen successful claims for mental anguish) which result from an accident that is directly or indirectly caused by the use or operation of an automobile. According to you there was no accident, so there can't be any injuries associated with an accident. The only thing you might have is OCD because you seemed to have irrationally obsessed over the accusation. If you want to claim injuries then you'll have to admit there was an accident. Even if there was an accident you'll have to show your mental trauma was caused by the accident, not by the accusation of being involved in an accident.
