I was in an accident where a driver rear-ended me-(100% his fault). He had PIP insurance, so I was able to start the healing process right away. Eventually, the $ 10,000 was used up and I ended up settling my case. But WHY did I have to pay back that $ 10,000 out of my settlement?? I thought that the whole point of insurance was to cover you without you having to pay, especially when it wasn't my fault and we're talking about paying back HIS insurance company! SO LOST!! Help me please.

In states that require PIP the other driver is not responsible for your medical bills even if he is at fault. It sounds as if you didn't have insurance. PIP is insurance you must carry to pay your medical bills. .
