If you settle a case and there has been no judgement entered and there is no prevailing party, does either party stand a chance of claiming attorney fees if there is no prevailing party?

Unlikely. The settlement agreement, as a general matter, is a resolution of the case. This includes damages.
You may have an exception in certain consumer transaction cases.
