You are correct. However if you decide not to pay then there are other legal remedies to get that money. Liens, garnishing of wages, seizure of property, destruction of your credit rating, etc.

Not automatically, no. You can follow your jurisdiction's procedure for obtaining a levy on the bank account, though. Or place a lein on their property, garnish wages, etc. But it's up to you to do the legwork, not the court.
