I went out for lunch with my friend-you know, catch up etc and we chose to eat at a noodle bar where i had seafood noodles. We went to a pub afterwards and sat around until around 6 talking, where I had maximum of 4 glasses of wine. Next thing I remember is being in hospital, throwing up and feeling extremely nautious!
I was told later that I had passed out on my way home and I was unconscious for over 5 hours, and they cudnt even feel my pulse as it was so weak. As I HAD been drinking wine they decided to take my blood and test it-and they told me they coudlnt find anything wrong with my blood.
Being A+E and busy they really didnt have enough time for me (even though i was half unconscious...blacking out frequently and throwing up all over the place)
my husband took me home later and I spent the night in a lot of pain and throwing up again. In the morning we decided to take me to the local GP who told us that she doubts it was anything to do with the alcohol as 4 glasses nearly isnt enough to get somebody like that and it was over a few hours-also because they cudnt find anything in my blood and she came to the conclusion that it was the seafood from lunch-which makes sense cuz I've been served very obviously gone off food from the place before and I had to send it back. Its been about 2 days and I'm still feeling really really crummy. Sick and nautious.. I rung the restaurant who said they'll investigate it. My doctor is willing to write out a doctors certificate saying that its food poisoning that im having.

Now the issues I am having are these: When people get food poisoning its few days of being sick and ok but surely if i was hardly breathing for 5 hours etc thats more serious? Should I talk to anybody else besides the actual restaurant? I have a kid under 1 to look after and I've been told I can claim under 'personal injuries' for compensation.. is this true?

also my husband tells me when I passed out-he took me to the nearest health clinic-when he tried to get me out I fell onto the floor so he called to the so called paramedics by the ambulance for help who apparently pretended he saw nothing and tried to walk away! My husband asked again for help and evidentally the paramedic said 'why did you bring her here? this isnt the A+E' and he needed to be CONVINCED to help

My husband and I are absolutely fuming over this and we were wondering if we should take this to his boss or i dunno... the police? Are we over reacting?

I remember the first time I had food poisoning too but there really isn't much anyone can do about it. You sound like you are totally over reacting to me. Sorry if this wasn't what you wanted to hear.

I got food poisoning from shrimp at a pub. About 4 hours after I'd eaten. Not as serious as you, but severe vomiting and diarrhoea. Not fun. We were supposed to be on a romantic getaway, and I spent 3 hours in the bathroom, and then made my husband drive home in the middle of the night.

I actually did nothing about it. The next day I felt better, but not great. I decided I would never eat there again.

In a lawsuit, you will have to prove negligence. You will have to prove the restaurant knew the seafood was bad, and deliberately served it to you. I think this would be hard to prove.

Also a personal injury lawsuit is a long drawn out process. The lawyers from the "other" side are vicious.

I think your best bet is to try and deal with the restaurant, and see if they will pay the ambulance bill etc. You wouldn't get much in a lawsuit. The "pain & suffering" part of a lawsuit, is actually a very small portion. Most of the money in this type of lawsuit comes from lost wages, rehabilitation, future lost wages.
