How are you paying for your medical bills? If you're using your health insurance, your insurer will likely subrogate (attempt to recover costs from him and his insurer) whether you want them to or not.

You report the incident IMMEDIATELY. That doesn't mean you have to file a claim for damages, but you report it happened, or you will be denied any future claim. Even a few days raises questions.

HOWEVER.

If you don't get treated right away for the injury - if you don't confirm it with a doctor or hospital - you're going to have a darned hard time proving that your doctor visit, four months after the hospital, was because you had injuries from an accident way back when.

Also, they don't pay for your medical care up front! They will reimburse you later. Maybe. If there's coverage, depending on what state you are in, and several other things.
