hi
i was headbutted last night which resulted in my lip being burst, can i put a claim for compensation in before the case goes to court?

Answer by Landlord
Yes, that is part of the process.

You have to put your claim out and give them 30 days to pay, then you go to court.

In court you would have to prove the case and present the medical bills, which is all you can claim.

If you were headbutted, and the charge against the person that attacked you is assault, there is no compensation involved. It's a criminal case. The only thing involved is a fine/jail for the attacker. The prosecutor must prove the attacker is guilty "beyond a reasonable doubt."

If you are looking for compensation for your injuries, it's a civil case (not criminal). In this instance, your lawyer must prove to a judge/jury that you were wronged, entitled to financial compensation, and that a "preponderance of the evidence" shows that the accused is responsible and needs to make reparations.

I'm not sure who you think you can put a claim in for compensation before the case goes to court with. Good luck!

Yes you can sue in civil courts at anytime separate from the criminal court action.

Most people would not do so, because it gets down to a a dispute between parties, which could go either way. If you wait until the criminal complaint is decided, you have the weight of that case verdict on your side.

You can claim whatever you want from anyone you want. If you are trying to ask if whoever butted you is likely to whip out a checkbook and start giving you money without being ordered to, that seems unlikely.
