I was in a car accident 5 days ago with my children. The person was on the cell phone when I got hit and according to a witness the person blew the stop sign. The person ended up hitting me on the driver side of my car and since we were in opposite directions the other car got hit on the driver side as well. We both hit each other but the other car was all over my lane and when I realized this person wasn't going to move into their lane I braked but it wasn't fast enough and we both hit. To my understanding the person who collided with me got the ticket for being on the cell phone, not sure if received a ticket for blowing the stop sign. We were taken to the hospital in an ambulance and were release the same day with minor injuries (bumps, bruises and I got stitches in my mouth). I took the minimum days of work three days and can't afford to take more time because I recently began this new job and have a mortgage. I made the claim with their insurance since it wasn't my fault and I gave a statement. I was told by the claim department they would contact me. I called the claim on thursday since I hadn't heard from them and they told me they haven't gotten in contact with the other party. This is my first accident and I don't know what to do? My car is and older car, but was in great functioning condition for my job. I depend on a car for my job everyday and since I only have liability my insurance doesn't cover me. Please does any one have any advice. I am nervous because I haven't heard from them or they haven't made a claim against me.

It usually takes the insurance company a little while to get ahold of the other party, I had an accident a little while ago and it took a while for the insurance company to get ahold of the person who was at fault, assess the damage, look at our vehicle, and create a settlement. They just want to make sure that they have all of their bases covered, and yes, get out of paying as much as possible. basically how its going to work is; they'llll call you eventually and ask you to have about 3 mechanics take a look at your car and if the damage is about 75% of the value of the car (I think the value of the car in its condition, not blue-book) they'll consider the car "totaled" and just cut you a check, otherwise they'lll just cover the bills. Some people's insurance covers rental cars too, so ask about that to make sure that you can get one to get around.

You would have been mailed a ticket by now if you didn't get one on site.
They were obviously at fault in the eyes of the police report. No worries, insurance companies are tight wads and don't give up money without a fight.
They will take those payments but they hate paying YOU.
Takes time, and liability is all you need. If it goes to small claims court which I sincerely doubt it will, you have a witness on the police report as well as a citation to the other party which rules in your favor.

Report it to your insurance company, and make sure they get a copy of the police report when it's available. The insurance companies will talk and work out the details and let you know.

Escalate with your insurance company. Contact your agent if you have one. Be certain they understand that you were not at fault, and the other party was given the ticket.

Most insurance companies are notoriously slow in processing accident claims. If the other driver was cited for anything, and you received no ticket, then most fault will be on them.
Talk with your insurance agent about how these things are usually handled. He/she can probably give you a lot of insight as to how it works.
You might want to contact a lawyer and file suit against the other party and their ins. co. for your family's injuries, for your loss of work, the loss of your car and for your lawyer's fees. That usually gets really quick response from their ins. co.

If you only have liability, you're kinda screwed. The only way to get your car fixed in a timely fashion would be to pay out of pocket and keep your receipts and add the total to your claim. This is no quick process. I was in an accident nearly a year ago and the driver of the vehicle I was in wasn't at fault but did have collision coverage. Her insurance did fix the car, but is now going after the other driver. We have yet to see any compensation from the driver at fault.

The other parties insurance company has a right to try to get ahold of their driver for their statement.
However, if you have collission coverage on your car insurance policy I would have your insurance company handle the damages to your car. Then you can put in a bodily injury claim with the other carrier for them to handle that part.
You might consider getting an attorney to handle your bodily injury. But get your insurance company involved ASAP. They can help you through all this mess. And, yes it will take some time. Your insurance company can help speed it up the process.

Personally I would let my attorney handle the case.
It can take months & years to recieve any money from an insurance company so there taking time to get the facts is a good thing. Our first accident took 8 months to get a dime out of the company.
