My hubby was in an accident a couple of days ago. His car is mangled and he is suffering from back pain. After accident he went to the ER to be checked and was fine as far as they could see. He wants to file through the driver at fault's insurance so not to raise our price. The police did not let him get his insurance info so we are waiting for the report. What happens now?? What do we do?? Will they offer a settlement and how soon??

Have your own insurance agency do the work for you. That's what you pay them for.

If it has been a couple of days you should be able to get a copy of the accident report. It will probably cost you a few dollars. In the mean time you might try calling the police department's records division and they may just give you the insurance information via telephone if they are not a very big department

See your own insurance agent. We buy our insurance from a real human being even though I probably could save money buying online because the guy knows us, how much risk we are willing to take, and exactly what we need to protect (umbrella insurance). They also handle claims, get the information we need, deal with the other company.

Tell your husband what my doctor told my husband who got whiplash from doing an exercise wrong: the pain may not show up for several days and damage can't be seen on x-rays. We never exaggerate injuries, but if your husband was injured, he shouldn't sign off on anything until his doctor says that it is safe to do and his insurance company recommends it.

If you have problems, ask around other people to get their experiences and suggestions. Sometimes the other guy's insurance drags their feet, fights tooth and nail not to pay, "loses" paperwork. Hope that the guy actually has insurance and that it is listed in the police report. You do have his name, address, phone, or should have gotten them from him at the time.

Once the insurance companies determine who is at fault, you will negotiate to get the settlement you deserve. This can take a while. Call your agent or company.

Going to the ER was the best thing your hubby could do to start his claim against the other driver but he also needs to see his doctor about his on going back-pain. Whiplash can take some time to really show up after a accident, be warned .

About filing a claim: Even if you go through the other driver's insurance they (the other driver's insurance) is still going to get your ins. company involved. You need to just go and use your own and let them fight it out. The important thing is not who's insurance company get used, but how is your husbands back going to turn out after all this. Your insurance company will find out sooner or later which ever way you go, that's just how THEY work. But in order to care for your hubby's back you need to take control and see all the doctors you need too. And it will help if you have to sue someone. Like it or not his back is the most important case, not if my insurance is going to be higher. God Bless

Depending on the state in which you reside, you can go to the police substation and pick up the report (some states you have to go pick it up). The officer should have given him a case or incident report number. Good you have a medical document, bad it says he was fine. Did the other driver get ticketed at fault for the accident. Some states are 'no fault', so regardless who is to blame, both file with their own insurance. Then, the insurance companies hash it out between themselves. Sounds like you have at fault. Call your insurance company to get involved in the process. They are going to handle the case anyway, but you should stay on top of what transpires. In some instances, neither insurance company will accept fault and the case can go to trial. Your husband will be called to testify and if the court determines the other driver is at fault, your husband could be awarded a settlement and/or payment for damages to his car. Like I said, I don't know where you live, so go online to the DMV (be careful, there is a non-governmental website listed as 'DMV.org') in your state. You should be able to find definitive information on auto accidents, insurance issues, etc. there.
