a car rear-ended me one night. after i made a claim to his insurance company, his insurance company said that they will deny my claim because that guy was also rear-ended and he was dragged into my car.
i did not see any car rear-ending the car behind me. when i told that insurance company that your customer might be lying to you, and i asked them if they are going to go for his words. then that insurance company told me that, wouldn't your insurance company do that for you.
what should i do in this case?
any help is appreciated.

If you have full coverage insurance, then ask your insurance co for help. They can fix the car, and then sue the other insurance and the owner. If you have liability only, then notify the dmv that the owners insurance denied coverage. then go down to the court clerk and get the paperwork for a small claims action. you need to pay the court some fees, and have the sheriff serve the papers to the insurance company and the owner of the vehicle. Make sure to follow the guide lines of the small claims (I believe you need to send both the insurance co. and the cars owner a demand letter, include a copy of the damage estimate, I would get three estimates, pick the one you like the best and submit it.
You can ask the judge for court costs, and you will win this case. Most insurance companies, do not want a judgment against them, and may pay the estimate before court.
I know it sucks, meanwhile try to get the car fixed, and keep up the faith and go to court if you have too. good luck stand up for your rights, and in your demand letter be sure and thank the insurance company for trying to screw you, and tell them you will never buy insurance from a cheap company who cheats people.

Easy one you are claiming off the one who hit you. Full Stop.
Tell your insurance company what the other insurance company have said NOW including anything in writing.
Then contact the other insurance company and just say any further communication is to be through your insurance company, That is what you pay them for.
You are in Car 1, You were rear-ended by Car 2 so he was at fault as far as you are concerned. Forget anything else, That is down to the driver of Car 2, If he was rear-ended by Car 3 and pushed into you, his insurance will pay your claim then add that to the claim they make against Car 3.

Call your insurance company and tell them about the accident and the persons story to there insurance company. Even if the person was rear ended that hit you. it will still be his insurances company`s responsibility. Call his insurance company back. And tell them that if you do not get them to cover the accident you will be calling an attorney and he will file a law suit for not only damages but also the rental car you will be getting and personal bodily damages. And i`m sure an attorney can think of other reasons.
