I assume you failed college as well. Your grammar is horrible. Your question is unclear. It ask about getting a loan yet your explanation talks about avoiding payment of the loan. See a bankruptcy attorney. You can find them in your local phone book or online.

You can't declare bankruptcy on student loans. You are working so your loans are not eligible for deferment. You can call your lender and ask for a forbearance due to financial difficulties, that will relieve you from having to make payments for a little while but all of the interest charges will capitalize during that time.

You can also ask your lender about refinancing or re-amortizing your loan to extend the payoff time and lower your payments.

There are limits to what percentage of your income they require for payments on the student loan, if you are a lower income worker you can ask about those.

This might be surprising to you, but lawyers don't work for free. Since you have not been harmed by the lender you are not going to get any money from suing them. That means that you will have to pay the lawyer yourself.

You need to call your lender and ask them if you can change your payment plan. Tell them the way it is set up now is more than you can pay per month. Be sure and send them something every month, even if it's below the requested payment amount. If they ever take you to court for non-payment, then you will be able to say you did your best to pay. But if you just don't send them anything sometimes, you aren't going to win that argument.

A lawyer isn't what you want anyway, a debt counselor is more like it. There may be some in your yellow pages, or you could ask at your local chamber of commerce. But first try yourself to get your lender to set you up on a new plan.
