I'm writing an article about accidents for my school newspaper and I want a clear definition of what an accident claim is to make my point clear to readers.
Help?
Answer by It's That Guy
If you have an accident, and you have insurance, you call your insurance company and they have a guy who interviews you and decides what you are entitled to. You have a 'claim', which is a legal word meaning that someone owes you something and you have the right to ask them for it. You are 'filing a claim'.
If the accident wasn't your fault, you go to the person whose fault it was and you tell him how much you think he should give you for your damages, plus your inconvenience, for 'pain and suffering', etc. If he has insurance, you work with his insurance company, and they make you an offer. If he doesn't have insurance, you mail him a letter telling him how much you want, and the sum is usually negotiated. You might have to sue him. You have a 'legal claim'.

Much like health insurance, you pay into car insurance for certain benefits, the type and amount of benefits to be determined by your needs, your ability to pay, and certain state requirements (such as property damage liability). When you are involved in a loss, you file a claim, or a request, with the insurance company to make use of those benefits, such as a cash payment, for that loss. Your insurance company will then pay out for that loss, such as a cash settlement based on the amount of damages to your property, or paying for your medical bills, provided that it is a covered loss. Your policy explains what a covered loss is. You will also be required to pay a deductible, which is similar to a co-pay. Deductibles are the portion you are responsible for.
A loss can be a collision, or other perils that may cause damage to your vehicle, such as falling objects, weather-related incidents or vandalism. Theft is another type of loss.
Hope this helps!
