working. It happened on a Thursday night. I told the apartment manager about it Friday morning. She said she would tell the property owner and get someone out to fix it. Friday passed, no plumber. Satuday evening came and I had to go over and ask the manager about fixing my toilet. She said she told the owner and the owner said that she would have a plumber come out monday because she didnt want to pay the emergency overtime fee that plumbers charge on the weekend. I was very mad so I complained. Eventually I raised so much fuss that they did send a plumber out but the landlord said I was going to have to pay all fees, including getting the toilet replaced because she said it was in the lease. The clog was not my fault though. I dont know how it happened. She charged me 595 dollars which I refused to pay. She said she would get a collection agency on me and make me pay. I offered to take it to court but she said she didnt want to. What are my rights? Can I win in court? Help!!!
the clog was caused by a plastic deodorant holder. I never bought one or put it in my toilet and i have no clue where it came from.

I don't know if you can win or not, but I sure would try. That just doesn't sound legal.

your landlord is trying to bully you....... ask a lawyer...... most lawyers wont charge u on your first visit..... ask first..... dont pay it and go to court.... u will probably win...... but u should start looking for another apartment....... file a counter suit for harassment...... u may not win it but she may want to settle out of court cause she is being unreasonable.

They can only charge you if it's your fault that the plumbing isn't working. ie the clog was from trash other then toliet paper being flushed down the toliet.

They legally only can charge for things beyond normal wear and tear. As long as it was toliet paper then there's nothing beyond normal wear and tear.

It's not up to her if you take it to court. It's your legal right to go there, and if you win you can ask for lawyer fees, etc.
