They are consistent with the presumption of innocence. In England and other Old World Monarchies, the innocently accused had to prove their innocence, which hardly was just.

In American Jurisprudence, it is better to let a guilty person go free than it is to incarcerate an innocent person. This is especially true with the death penalty.

In theory, a defendant is released on bail to prepare a case for his defense. This seems fair particularly if one is presumed to be innocent. How would you like it if you were accused of a crime that you did not commit? Thank God for the US Constitution.
